1. What information do we collect?

Information you provide directly:

·Names, email addresses, usernames, and passwords
·Profile details such as company name, bio, and profile photo
·Campaign and deal information
·Messages sent through the platform's messaging system
·Payment data, handled and stored by Stripe. We do not store your card details.
·Tax information for creators we pay, such as legal name, address and Social Security or tax ID number. This is collected and stored by Stripe to issue 1099 tax forms. We never see or store your full SSN.
·Date of birth and work authorization status, used to confirm you are 18 or older and eligible to be paid
·Shipping addresses, when a campaign sends you a product

Social login data:

If you connect a social media account (Instagram or TikTok), we receive profile and content performance information from that provider as described in Section 3 below.

Information collected automatically:

·IP address, browser type, device characteristics, and operating system
·Pages visited, actions taken, and session data
·Approximate location based on IP address
·Referring URLs and language preferences

2. How do we process your information?

We process your personal information for the following purposes:

·To facilitate account creation, authentication, and account management
·To match creators with relevant brand campaigns
·To process payments and manage transactions
·To issue 1099 tax forms to creators paid $600 or more in a year and file them with the IRS
·To send administrative information, updates, and notifications
·To respond to user inquiries and provide support
·To detect fraud, enforce our Terms, and protect the platform
·To identify usage trends and improve our Services
·To comply with legal obligations

3. Instagram and TikTok data

Connecting Instagram or TikTok is optional. We only request read access, and only to verify your account and show campaign performance to you and the brands you work with.

Instagram (Meta)

If you connect a professional Instagram account, we use the Instagram API with the instagram_business_basic and instagram_business_manage_insights permissions to collect:

·Instagram user ID, username, account type, and profile picture
·Follower count and media count
·For posts you submit for a campaign: the post link and its insights (views, reach, likes, comments, shares, and saves)

TikTok

If you connect TikTok via Login Kit, we use the user.info.basic, user.info.profile, user.info.stats, and video.list scopes to collect:

·TikTok open ID, username, display name, and profile picture
·Follower count, following count, total likes, and video count
·For videos you submit for a campaign: the video link and its public stats (views, likes, comments, and shares)

How we use and share it

·To verify you own the account you list on your profile
·To show your audience size to brands considering you for a campaign
·To report views and engagement on campaign posts to you and to the brand that paid for them

We never post, comment, or message on your behalf, never access your private messages, and never sell this data or use it for advertising. Access tokens are stored securely on our servers and used only to refresh these stats.

You can disconnect either account at any time in your Creator settings, or by removing Creator from Instagram (Settings → Apps and websites) or TikTok (Settings and privacy → Security → Manage app permissions). When you disconnect, we stop collecting new data. To delete what we already hold, see Section 8 or our data deletion page.

4. What legal bases do we rely on?

We only process your personal information when we have a valid legal basis to do so. Depending on your location, we may rely on:

·Consent: where you have given us specific permission
·Performance of a contract: to provide the Services you have signed up for
·Legitimate interests: to operate, improve, and protect our platform
·Legal obligations: to comply with applicable law

If you are located in the EU, UK, or Canada, you may withdraw consent at any time where consent is the basis for processing.

5. When and with whom do we share your information?

Brands and creators

Your profile information is visible to the other party when you are working on a campaign together.

Service providers

We share data with trusted third-party providers that help us run the Services, including Stripe (payments), Supabase (database and authentication), Vercel (hosting), Resend (email), Calendly (demo scheduling), and analytics services. These providers are bound by confidentiality agreements and may only use your data as directed by us.

Business transfers

In connection with a merger, acquisition, or sale of assets, your information may be transferred as part of the transaction.

Legal requirements

When required by law, court order, or to protect the rights and safety of Creator Software Inc., our users, or the public.

Affiliate links

If a campaign uses affiliate codes or tracked links, we count clicks on those links and share click and order totals with the brand and the creator on that campaign.

We do not sell your personal information to third parties.

6. Do we use cookies and tracking technologies?

We use essential cookies to keep you logged in and remember your preferences. We measure how people use the platform with Vercel Analytics, which does not use cookies or track you across other websites. We do not use advertising cookies. You can control cookies through your browser settings, though you will need them enabled to log in.

7. How long do we keep your information?

We retain your personal information for as long as your account is active or as needed to provide the Services. No purpose in this policy will require us to keep your information longer than the period in which you have an account with us, unless a longer retention period is required by law (such as tax or accounting requirements). Upon account deletion, we remove your personal information within 30 days. Records of completed deals and payments may be kept as long as tax and accounting law requires.

8. How do I delete my data?

You can ask us to delete your data at any time:

·Instagram or TikTok data only: disconnect the account in your Creator settings or remove Creator from the app's permissions. Instagram removals are processed automatically through Meta's data deletion callback.
·Your whole account: email hello@joincreator.co from the email on your account with the subject "Delete my account".

We confirm deletion requests and complete them within 30 days. Full instructions are on our data deletion page.

9. How do we keep your information safe?

We have implemented appropriate technical and organizational security measures designed to protect your personal information, including encryption in transit and at rest. However, no electronic transmission over the internet can be guaranteed 100% secure, and we cannot promise that unauthorized third parties will never be able to defeat our security measures.

10. Do we collect information from minors?

Creator is not directed at children under 13, and we do not knowingly collect personal information from anyone under 13. Brand users must be at least 18. Creators under 18 may use the Services only with the consent of a parent or legal guardian, as described in our Terms of Service. If we learn we have collected information from a child under 13, or from a minor without the required consent, we will delete it.

11. What are your privacy rights?

Depending on where you are located, you may have the right to:

·Request access to and obtain a copy of your personal information
·Request correction of inaccurate data
·Request deletion of your personal information
·Restrict or object to certain processing
·Data portability
·Withdraw consent where consent is the legal basis

12. Controls for Do-Not-Track features

Most web browsers include a Do-Not-Track ("DNT") feature. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals.

13. Do United States residents have specific privacy rights?

If you are a resident of California, Colorado, Connecticut, Utah, Virginia, or other US states with applicable privacy laws, you may have the right to request access to, correct, or delete the personal information we maintain about you. You also have the right to non-discrimination for exercising your privacy rights. To exercise these rights, email us at hello@joincreator.co.

14. Do we make updates to this policy?

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated date at the top. If we make material changes, we will notify you by prominently posting a notice or by sending you a direct notification before the changes take effect.
